2. What these terms cover
These terms apply to every order placed through bmmeubelen.com. By placing an order you accept them. If you are buying as a consumer, nothing here takes away rights the law gives you — where a clause conflicts with your statutory rights, the law wins.
3. Products
We make furniture by hand. Wood is a natural material, so grain, colour and figure vary from piece to piece, and a small variation from the photograph is normal rather than a defect. Photographs and dimensions on the site are as accurate as we can make them; the dimensions in your order confirmation are the binding ones.
4. Prices
Prices are in euro and include 21% Belgian VAT. Delivery is charged separately and is shown before you confirm the order. We may change prices at any time, but the price that applies to your order is the one shown when you placed it.
5. How an order is made
Placing an order on the site is an offer to buy. The contract exists once we send you an order confirmation by e-mail. If we cannot accept the order — a piece is no longer available, or a price was obviously wrong — we will tell you and refund anything you have paid.
6. Payment
Payment is taken at the time of ordering through Stripe. We accept credit and debit cards, Bancontact and Link. Card details are entered on Stripe’s systems; we never see or store them.
For made-to-measure pieces the terms of payment are set out in the quote we send you.
7. Delivery
We deliver within Belgium. You can also collect free of charge from our workshop at Dendermondsesteenweg 220, Willebroek, by appointment.
- Doorstep delivery — €85. We bring the furniture to your door.
- Delivery and installation in the room — €150. We carry it in, place it and assemble it where you want it.
- Collection from the workshop — free.
We agree a delivery date with you once your piece is ready. Please make sure the route in — stairs, doorways, lifts — is wide enough for the piece you ordered; if delivery fails because it will not fit or nobody is there, we may charge the cost of the second attempt.
Risk passes to you when the furniture is handed over. Check it on arrival and tell us about visible transport damage within 48 hours, with photographs, so we can take it up with the carrier.
8. Made-to-measure furniture
A quote request costs nothing and commits you to nothing. A made-to-measure order begins only when you approve a written quote setting out the dimensions, materials, finish, price and lead time.
Because these pieces are made to your specification, the 14-day right of withdrawal does not apply to them (Article VI.53, 3° of the Belgian Code of Economic Law). Your legal warranty of conformity applies in full.
9. Right of withdrawal
If you are a consumer you have 14 days from delivery to change your mind about a standard, non-customised piece. How to do it, what it costs and what is excluded are set out on our Returns and Right of Withdrawal page, which forms part of these terms.
10. Legal warranty
Consumers have a legal warranty of conformity of two years from delivery under Belgian law. If the furniture does not match what was agreed, you may ask for it to be repaired or replaced free of charge and, where that is impossible or disproportionate, for a price reduction or a refund.
The warranty does not cover normal wear, damage caused by misuse, accident or unsuitable conditions such as prolonged damp or direct heat, or changes made by anyone other than us.
Tell us at info@bmmeubelen.com, with your order number and photographs, as soon as you notice a problem.
11. Complaints
Write to info@bmmeubelen.com. We answer within seven working days and try to resolve things directly.
If we cannot agree, a consumer may take the matter to the Belgian Consumer Mediation Service, North Gate II, Koning Albert II-laan 8 box 1, 1000 Brussels — www.consumerombudsman.be.
12. Circumstances beyond our control
We are not liable for delay or failure caused by events outside our reasonable control, such as fire, flood, strike, or the failure of a supplier we could not have foreseen. If such an event lasts more than 60 days either of us may cancel the order and we will refund what you have paid.
13. Liability
Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law does not allow us to limit. Otherwise our liability is limited to the price of the order.
14. Applicable law
Belgian law applies. Disputes go to the courts of Antwerp, Mechelen division. A consumer may always bring proceedings before the court of their own place of residence, and may always rely on the mandatory rules of the country in which they live.
15. If part of these terms fails
If a court finds one clause unenforceable, the rest stays in force and the clause is read down to the nearest lawful meaning.
